TERMS AND CONDITIONS OF ROFREETEA.COM ONLINE STORE

§ 1. GENERAL PROVISIONS

  1. The online store available at www.rofreetea.com is operated by Biotini Michał Wiśniewski with its registered office at ul. Herbu Szreniawa 11/5, 02-972 Warsaw, Poland, NIP: 9512122283.

  2. These Terms and Conditions define the rules for using the online store, placing orders, and their fulfillment.

  3. Contact with the Seller is possible via email at hi@rofreetea.com or by phone at (+48) 728 437 147.

§ 2. ORDER PLACEMENT CONDITIONS

  1. The store sells goods via the Internet.

  2. Orders are accepted through the form available on the store's website www.rofreetea.com.

  3. Orders can be placed 24 hours a day, throughout the year.

  4. To place an order, it is required to provide personal and address information necessary for order fulfillment.

§ 3. ORDER FULFILLMENT

  1. Order processing begins after the payment is credited to the Seller's account or upon choosing the cash on delivery option.

  2. The order fulfillment time is up to 3 working days unless otherwise specified for a particular product.

  3. Goods are delivered to the address specified by the Buyer.

  4. Shipping costs are specified during the order placement process.

§ 4. PAYMENT

  1. The Buyer can make payments: a. via bank transfer, b. through electronic payments, c. cash on delivery upon receipt., via credit/debit car Visa/Mastercard

  2. The entity providing online payment services for fast bank transfers is PayPro S.A.

§ 5. WITHDRAWAL FROM THE CONTRACT

  1. The consumer has the right to withdraw from a distance contract within 14 days from the receipt of the goods.

  2. To withdraw from the contract, the consumer must inform the Seller by email at hi@rofreetea.com by sending a statement of withdrawal.

  3. The return of the goods should take place immediately, but no later than within 14 days from the date of withdrawal.

  4. The cost of return shipment shall be borne by the Consumer.

  5. All returns must be sent to the company's address: Biotini Michał Wiśniewski, ul. Herbu Szreniawa 11/5, 02-972 Warsaw, Poland.

§ 6. COMPLAINTS

  1. The Seller undertakes to deliver goods free from defects.

  2. In case of finding a defect, the Buyer has the right to file a complaint.

  3. Complaints should be reported by email at hi@rofreetea.com, including a description of the defect and proof of purchase.

  4. Complaints will be processed within 14 days from the date of notification.

  5. All returns must be sent to the company's address: Biotini Michał Wiśniewski, ul. Herbu Szreniawa 11/5, 02-972 Warsaw, Poland.

§ 7. WARRANTY AND CONFORMITY OF GOODS (Food Products, including Tea)

  1. The Seller is liable under the statutory warranty for non‑conformity of food products (including tea) with the contract, pursuant to Articles 556¹–576¹ of the Polish Civil Code.

  2. No separate manufacturer’s guarantee applies; the Buyer’s rights arise solely from the statutory warranty.

  3. The Seller’s liability under the statutory warranty lasts for 2 years from the date the goods are delivered to the Buyer.

  4. Defects discovered after this period are not subject to statutory warranty claims

  5. If a defect is found (e.g., expired or spoiled product, mold, off‑taste or odor), the Buyer may demand, at their choice:

    • replacement of the goods with defect‑free items;

    • a proportionate price reduction;

    • rescission of the contract (if the defect is material and prevents consumption).

  6. The Seller is not liable if the Buyer knew of the defect at the time of purchase or if the defect resulted from improper storage, transportation, or use by the Buyer.

  7. The Buyer may file a statutory warranty claim within 2 years from the date of delivery of the goods.
  8. Given the perishable nature of food, the Buyer forfeits warranty rights if they fail to notify the Seller of the defect without undue delay and no later than 2 months after its discovery.

  10. The Seller shall resolve each claim within 14 calendar days from the date of its receipt. Failure to respond within this period shall be deemed acceptance of the claim.

  11. The Buyer shall bear the cost of returning the goods unless the defect prevents the Buyer from collecting the shipment—in which case the Seller will cover return shipping.
  12. Upon acceptance of the claim, the Seller shall reimburse the Buyer for return shipping costs.

§ 8. PERSONAL DATA PROTECTION

  1. The administrator of the Buyers' personal data is Biotini Michał Wiśniewski.

  2. Personal data is processed solely for the purpose of fulfilling orders and may be processed for marketing purposes if the Buyer consents to it.

  3. The Buyer has the right to access, correct, delete, and restrict the processing of their data in accordance with GDPR.

§ 9. FINAL PROVISIONS

  1. Matters not covered by these Terms and Conditions shall be governed by the provisions of the Civil Code and the Consumer Rights Act.

  2. The Terms and Conditions are available on the website www.rofreetea.com.

  3. The Seller reserves the right to amend these Terms and Conditions. Changes take effect from the moment they are published on the website.
